applications, including the customer ordering app and the delivery partner
app (together, the "App"), and the website
nickithcakepark.com. This Privacy
Policy explains what information we collect, how we use it, and the choices
you have. By using the App or our website, you agree to the collection and
use of information as described in this policy.
1. Information We Collect
1.1 Information you provide
Name, phone number, and email address when you register an account
Delivery address and order details when you place an order
Payment-related information processed through our payment partners (we do not store full card details)
Messages you send us for support or feedback
1.2 Location Information
Delivery partner app: To provide live order tracking and
ensure timely delivery, our delivery partner app collects precise
(GPS) location data from delivery personnel, including
while the app is running in the background.
What we collect: Latitude, longitude, and location accuracy of the delivery partner's device.
When we collect it: Only while a delivery partner has marked themselves as "Available" for deliveries. Location updates stop as soon as the delivery partner goes offline or ends the session.
Why we collect it: To assign nearby orders to delivery partners, to show customers and our dispatch team the real-time location of their order, and to confirm successful delivery.
Why background access is needed: Delivery partners frequently switch apps, lock their screen, or use navigation apps while driving. Background location access allows live tracking to continue reliably in these situations so that in-progress deliveries are not interrupted.
Retention: Location data is retained for up to 90 days for operational, safety, and dispute-resolution purposes, after which it is deleted or anonymized.
Sharing: Location data is shared only with our backend systems and, where relevant, displayed to the customer for the specific order being delivered. We do not sell location data or share it with third-party advertisers.
Customer app: If you allow it, we may use your device's
approximate location to suggest a delivery address or estimate delivery
time. This is optional and only used while the app is in use.

2. How We Use Your Information
To create and manage your account
To process and fulfill orders, including assigning and tracking deliveries
To communicate order status, offers, and support responses

3. How We Share Your Information
We do not sell your personal data. We share information only:
Between customers and the assigned delivery partner, as needed to complete a delivery (e.g., delivery address, order details, live location of the delivery)
With service providers who help us operate the App (e.g., hosting, payment processing, push notifications), under confidentiality obligations
When required by law, legal process, or to protect the rights, property, or safety of Nickith Cake Park, our users, or the public
4. Data Security
We use industry-standard measures, including encrypted (HTTPS) data
transmission and authentication tokens, to protect your information.
However, no method of transmission or storage is 100% secure, and we
cannot guarantee absolute security.
5. Data Retention
We retain account and order data for as long as your account is active or
as needed to provide services, comply with legal obligations, resolve
disputes, and enforce our agreements. Location data is retained as
described in Section 1.2.

You can review and update your account information within the App
Delivery partners can disable location sharing by setting their status to "Unavailable," which stops location collection
You may request access to, correction of, or deletion of your personal data by contacting us (see below)
You can revoke location or notification permissions at any time from your device settings, though this may limit some App features
7. Children's Privacy
Our App is not directed to children under 13, and we do not knowingly
collect personal information from children under 13.
8. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be
posted on this page with a revised "Effective date." Continued use of the
App after changes take effect constitutes acceptance of the updated
policy.
